Terms of Service

Effective date: 8 April 2026. These terms govern your use of the website and services provided by Lumanaire (Pty) Ltd (“Lumanaire”, “we”, “us”). By accessing this website or engaging our services, you agree to these terms.

1. Services

Lumanaire is a digital agency providing website development, mobile app development, AI automation systems, digital marketing, content creation, SEO, and white-label CRM solutions (“Hub”). Specific deliverables, timelines, and fees are defined in individual project proposals or service agreements.

2. Intellectual Property

All content on this website — including text, design, code, graphics, and branding — is the property of Lumanaire and is protected under South African copyright law.

For client projects: upon full payment, clients receive ownership of the custom deliverables as specified in their project agreement. Lumanaire retains ownership of proprietary tools, frameworks, and reusable components used in the delivery of services.

3. Payment Terms

  • A deposit is required before work begins, as outlined in the project proposal
  • Invoices are payable within 7 days of issue unless otherwise agreed
  • Late payments may result in work being paused until the account is settled
  • All prices are quoted in South African Rand (ZAR) unless stated otherwise

4. Client Responsibilities

Clients are responsible for providing timely feedback, content, access credentials, and approvals as needed to keep projects on track. Delays caused by late client input may affect delivery timelines.

5. Limitation of Liability

Lumanaire provides services in good faith and to a professional standard. We are not liable for indirect, incidental, or consequential damages arising from the use of our services or this website. Our total liability is limited to the fees paid for the specific service in question.

6. Termination

Either party may terminate a service engagement with 14 days' written notice. Work completed up to the date of termination will be invoiced and is payable. Non-refundable deposits cover initial scoping and setup work.

7. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the courts of the Western Cape.

8. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated effective date.
